Middleton Reutlinger represents real estate developers, small business owners, corporate executives, physicians and other individuals in estate planning and estate administration matters. This includes overall planning of wealth management during a client’s lifetime, extending through the administration of estates and trusts. The firm prepares wills, living trusts, irrevocable insurance trusts, marital deduction trusts, prenuptial agreements, living wills and powers of attorney.

Estate planning also focuses on asset ownership, including insurance ownership and beneficiaries, the handling and disposition of pension and profit-sharing interests at retirement and death and methods to reduce death tax obligations. The firm also advises clients on making gifts, protecting business property before entering into a marriage and planning for succession in a closely held business.

Our attorneys use a coordinated planning process to minimize taxes while planning an estate or a business transaction. We feel this is necessary due to the often integrated goals of the closely-held business and the owners of such businesses. Recognizing the difficulties inherent in succession of a family owned business, the firm is experienced in advising the family how to ensure such succession, taking into account the financial and emotional well-being of all involved.

Frequently, during our representation of a closely-held business and its owners, we assist in the development of an executive compensation package, determine the structure of the legal entity for protecting the business and develop the estate plan for the owners. An example of the integrated planning approach is the buy-sell agreement which must consider the business needs, the estate planning needs of the owners and numerous other individual and corporate tax issues.

We also have assisted many clients in the probate of their estates and frequently work closely with various trust and financial institutions as well as individual fiduciaries in the smooth administration and distribution of the estate’s assets. We have the skills and experience to assist a taxpayer with his probate, estate and tax planning needs while facilitating business transactions and preserving hard-earned wealth on the transfer of assets to beneficiaries.
